Terms of Service	LINQX TERMS OF SERVICE Lawful Use: Linqx's system and services may only be used for lawful purposes and in a manner, which Linqx believes, in its sole discretion, to be consistent with the rights of other Linqx subscribers and third parties. Linqx believes in the extended privacy rights of children and supports recent legislation enforcing this. Linqx's services are not currently available to those under the age of 18. While Linqx is not responsible for the content of hosted Web Sites, content published and hosted on Linqx must comply with all applicable laws and must not infringe the rights of any third party. Linqx\u2019s services and system may only be used for lawful purposes and consistent with all rights of other parties. Without limiting the foregoing, Linqx\u2019s services and system shall not be used in a manner which would violate any law or infringe any copyright, trademark, trade secret, right of publicity, privacy right or any other right of any person or entity or for the purpose of transmitting or storing of material which is obscene, libelous or defamatory. Use and access to other networks through Linqx\u2019s system must comply with the rules for such other networks. Changes to Service: Linqx reserves the right to change or modify any of the services or features present on it without notice, including changes to access and use procedures, pricing and system hardware and software that the system is running on. Termination and Suspension: Either subscriber or Linqx may at its sole discretion, terminate the subscriber\u2019s account at any time with or without reason. Linqx also may, at its sole discretion, suspend a subscriber\u2019s account at any time with or without reason. Both content creator as well as Linqx may at its sole discretion change the access of such content at any time with or without reason. Linqx may delete all data, files or other information that is stored in subscriber's account upon termination. Refunding of fees paid to Linqx by subscriber for loss of service due to violation of these terms is solely at the discretion of Linqx. Linqx is not responsible for data loss caused by insufficient space in a member\u2019s account. Explicit Content: Linqx\u2019s services are only available to those above the age of 18. In addition to this it is a content creator\u2019s responsibility to classify the content appropriately if it is expected to contain content that is explicit in nature. Linqx may at its sole discretion delete content, change access, suspend or terminate a subscriber\u2019s account at any time if it finds content inappropriate or incorrectly classified. Explicit content includes content containing nudity, violence, obscene, defamatory and libelous. Password Security: Your password may be used only to access the Site, use the Services, electronically sign your transactions, and review your completed transactions. You are solely responsible for maintaining the security of your password. You may not disclose your password to any third party (other than third parties authorized by you to use your account) and are solely responsible for any use of or action taken under your password on this Site. If your password is compromised, you must change your password. Compliance with laws: The Site and Services may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes, and regulations. You may not register under a false name or use an invalid or unauthorized credit card. You may not impersonate any participant or use another participant's password(s). Such fraudulent conduct is a violation of federal and state laws. Fraudulent conduct may be reported to law enforcement, and Linqx will cooperate to ensure that violators are prosecuted to the fullest extent of the law. Disclosure of information: Linqx also reserves the right to report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other third parties. In order to cooperate with governmental requests, to protect Linqx's systems and customers, or to ensure the integrity and operation of Linqx's business and systems, Linqx may access and disclose any information it considers necessary or appropriate, including but not limited to user contact details, IP addressing and traffic information, usage history, and posted content. Transmission of content: You agree to be solely and completely responsible for all of your transmissions onto and off of your Linqx account, and the contents of those transmissions. Linqx holds the right to terminate your access to the system at any time with or without reason, at Linqx\u2019s discretion. At the point at which you are terminated you have no further permission to access Linqx and Linqx is not obligated to give you access to any data that you have uploaded or inserted into Linqx.com in any way. Limitation of Liability: Use of Linqx\u2019s service and system and the Internet in general is at subscriber\u2019s sole risk. Linqx does not warrant that its service and system will be uninterrupted, error free, free from unauthorized intrusion, or that Linqx\u2019s services or system will meet any particular criteria of performance or quality; nor does Linqx make any warranty as to the results or information obtained from use of its service of system or the Internet in general. Linqx\u2019s service and system are provided on an \u201Cas is\u201D, \u201Cas available\u201D basis without warranties of any kind, either expressed or implied, including implied warranties of merchantability, fitness for a particular purposes, compatibility, security or accuracy, all of which warranties are hereby expressly disclaimed except to the extent any warranty cannot be disclaimed under applicable law. Under no circumstances shall Linqx be liable for any indirect, incidental, special, or consequential damages, including, without limiting the foregoing, Linqx will not be liable for damages resulting from the use or inability to use all or any part of the Linqx\u2019s system or services, reliance by any person on information obtained through Linqx\u2019s service or the Internet, deletion or loss of data, computer virus, any delay or failure of performance, or unauthorized access to records or files. Non-Transferability: Subscriber's account and right to use Linqx\u2019s services and system is not transferable. Subscriber agrees to protect its password and account and to keep them secure from unauthorized users and use. Hyperlinks: The Service may provide, or third parties or Members may provide, including, but not limited to hyperlink in member generated content area, links to other World Wide Web sites or resources. Because Linqx has no control over such sites and resources, you acknowledge and agree that Linqx is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Linqx shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. By agreeing to these terms of service, you also agree that when using a Communication Service in Linqx, you will not: · Use the Communication Service in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise). · Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others. · Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent topic, name, material or information, unless provided as content that is classified as having \u2018explicit content\u2019. It is a violation of Linqx\u2019s policy to post explicit/inappropriate content without classifying appropriately as being explicit in nature. · Publish, post, upload, distribute or disseminate any topic, name, material or information that incites discrimination, hate or violence towards one person or a group because of their belonging to a race, a religion or a nation, or that insults the victims of crimes against humanity by contesting the existence of those crimes. · Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same. · Use any material or information, including images or photographs, which are made available through Linqx\u2019s album system in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party. · Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another. · Use of meta tag searches on the web sites. . · Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner. · Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded. · Restrict or inhibit any other user from using and enjoying the Communication Services of Linqx. · Violate any code of conduct or other guidelines, which may be applicable for any particular Communication Service. · Harvest or otherwise collect information about others, including e-mail addresses. · Violate any applicable laws or regulations. · Create a false identity for the purpose of misleading others. · Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of Linqx or other user or usage information or any portion thereof. VIOLATIONS: Please report any violations of the TOS to our Support Staff support@linqx.com.
